| | | Invasion of privacy? -Alimony/Cohabitation What is the name of your state? Ohio
I just received via certified mail a letter from ex's attorney demanding I respond to the following questions I find to be absolutely disgusting, degrading, and an invasion of my privacy. The issue has to do with co-habitation and the desire to terminate my alimony. (We've been divorced since 2004.)
The first few questions ask about person(s) living in the home. Then they continue:
5) Please state the name(s) of each person(s) identified in your answer to Interrogatory with whom you have had sexual relations.
6) Please state the frequency and/or regularity in which you have had sexual relations with each such person(s) identified in the previous Interrogatory.
7) Please state the name(s)of each person(s) identified in your answer to Interrogatory with whom you sleep or have slept in the same bed.
8) Please state the period of time over which you sleep or have slept in the same bed with each such person identified in the previous Interrogatory.
Am I wrong? Does anyone have knowledge of successfully fighting this obnoxious tactic? If so, I'd love to hear from an attorney or organization who has been involved in the successful defiance.

MY RESPONSE: His name is IAAL. He's so masculine, with his 13"!! He also likes to hit my titties with it, too! 6) Please state the frequency and/or regularity in which you have had sexual relations with each such person(s) identified in the previous Interrogatory.
MY RESPONSE: Three times per day. He likes to sploooooge on my huge breasts and big nipples. Also, this question is vague as to the term "sexual relations." What does "is" mean? And, does this term take into consideration how many times IAAL likes to stick it in my ass? 7) Please state the name(s)of each person(s) identified in your answer to Interrogatory with whom you sleep or have slept in the same bed.
MY RESPONSE: Once again, that would be IAAL and, sometimes, the Seven Dwarfs, too. 8) Please state the period of time over which you sleep or have slept in the same bed with each such person identified in the previous Interrogatory.
MY RESPONSE: Usually between 14 and 18 hours per day, every single day. He's a much better lover than your client ever thought of being! IAAL loves to continually sploooooge me. Those sheets get sticky real quick!

My response:
Yeah, I wholeheartedly agree. I ask questions like that all the time . . . just to read the answers!
I even put questions like those in Discovery documents concerning contract issues!
NUMBER 19: Please identify, with particularly sufficient for a subpoena, all breaches of contract you allege in your complaint, and state who you slept with last night, and whether you got splooooged.

Thanks. | Before you think these questions are invasive, I would suggest you check the OHIO statutes on cohabitation and its effect on your alimony payments. You don't get to play house and take the ex's money.

You can co-habitate and still get alimony in Ohio (the state is backwards). I know someone whose court order awarded her alimony until a certain specific DATE and she got remarried and still received alimony. However if the court order states cohabitation/remarriage or the like then those questions are allowable and relevant. | |
