Malpractice


What is the name of your state (only U.S. law)? Texas

X has residency rights and is supposed to provide ins for child. No other child support. X would not show ins for years finally hired attorney and went for primary custody change in hopes just to make sure insurance provided.

Find out in mediation now the x is countersuing for child support. Our attorney and mediatar says you don't want to take this any further as they will win hands down bc in the courts eyes child support should have been paid all along.(the agreement at diviorce was not to pay any). So now in order to not pay child supprot we had to settle and we now have to pay for insurance. If the attorny would have told us up front we may have taken a different approach to just getting proof of insurance. Now it will cost $250 a month for the next 8 years. Is this malpractice on the attornies part?

Let me understand this - The other party is the custodial parent, pays all expenses for the child and is to cover insurance as well...

Basically as the non-custodial parent all you (or your significant other) had to do was enjoy the child without any type of responsibility financially speaking, true?

Yet for whatever reason, a decision was made to give away hard earned money to an attorney with the intention of obtaining a copy of an insurance card?! And to get the copy of the insurance card, it was the advice of the attorney to sue for physical custody placement?!

Umm...that's a bit difficult to believe...
