Marriage ending...


What is the name of your state? New York...

My boyfriend is trying to peacefully end his marriage, and he is the one paying all her bills at present. Well, actually he just put everything in her name except the mortgage, which is in both... and he wants to know what, if any, support he will need to pay her, and for how long. They were married for 16 years, and now she has 2 jobs... one full time, and one part time. He is paying for the divorce, and will be going to see a lawyer soon. Is it possible for him to remove his name off the mortgage as a term of the divorce? He wants to be off the mortgage, but doesn't want to force her to move by selling. He would also agree to pay her 1/2 the mortgage for 5 years just to help her out, again, as a term of the divorce.

Does anyone know if this is something legally attainable? I think he is trying to get a lower cost divorce kit, but isn't sure if what he is proposing is correct...

Thank you in advance for any suggestions...

The ONLY way he can be taken off the Mortgage is for her to refinance in her own name. Can she qualify on her own? Otherwise he is still responsible for that mortgage.

I'm sorry Julianna did you read your own post? Your boyfriend is trying to end his marriage? HIS wife works 2 jobs?! They've been married for more than 16 years - he's going to get to pay more than 5 years of the mortgage - but it's sweet of you to help him out

If he has already deeded his interest to her, he is stuck on the mortgage until it is paid off or she sells - whichever comes first. That would have been a really DUMB thing to do! He would no longer have any say over the property- only the obligation to pay on it or see his credit ruined.

Boyfriend, married 16 yrs! YEEEGADS! Not a good place to come where you will find many women that detest the "other woman". As for the advice on the house, it is correct, she will have to qualify for a mortgage on her own. Also, why doesnt your BOYFRIEND come here and ask his own legal questions? And honey, you might also want to be very aware of a woman scorned! Keep your nose out of their marriage and their divorce LOL
