What is the name of your state? Texas

Can a wife obtain spousal support when the husband has abandoned the marriage, the family and the home without obtaining a legal separation or divorce? Especially when he has been the sole source of income for support of the wife and kids and is no longer supporting the family. Also, is notification usually given to the other spouse if there has been a filing for legal separation? Or can there be a filing in the works and the other spouse not be aware?

I know that it is allowed in Florida, but Texas I'm not sure of. You can find the Texas laws by going to www.govengine.com click on Texas and it'll give you links to the laws.

Thanks, Gracie. That website was very informative. Seems to be very strict in Texas on being able to obtain support, and doesn't appear likely in this case where abandonment has been the issue here. Guess the next step is the advice of a lawyer on this one.
