Question

MY pension


What is the name of your state (only U.S. law)? Washington
i want to divorce, however I am rolling over my 401K plan to an IRA. Is there any paperwork to protect this money from him? Something like a quit claim? Thank you.What is the name of your state (only U.S. law)? WA.

In a divorce, you are each entitled to 1/2 of the assets that have accrued during the marriage, and reponsible for 1/2 of the debts that accrued during the marriage. Whatever portion of your 401k that accrued during the marriage will be a marital asset, to be split, unless it can be exchanged for you keeping extra marital debt or exchanged for another marital asset.

Does this mean that the stbx husband is 'potentially' entitled to the portion of 401k that accrued during the marriage??
