not sure what I owe


What is the name of your state (only U.S. law)? Ca
In my divorce agreement I was ordered to pay alimony in the amount of $800 per month, which I could not afford, and my ex wife knew that. She agreed to forgo alimony if I paid for medical coverage. Due to my ex wifes health problems I have not been able to find coverage for her. I informed her when she was declined for coverage and she said she would try to find some coverage, which I would pay for. I did not hear back from her regarding the coverage. I recently became a father and my ex wife found out. She now is attaching my wages for alimony. The alimony was supposed to be for 3 1/2 years, the medical coverage was supposed to be until I sold our residence, which I have been unable to due. Which one do I owe, alimony or for medical coverage??

You owe whatever your court order says you owe.

Was your agreement to pay medical in lieu of alimony made a part of a court order, signed by a Judge?

I think it was but I am not able to find the court papers.

You'll need to go to the courthouse to get another copy of your decree(s).

Call the courthouse that handled your divorce. Ask them about getting a certified copy of your divorce papers. Heck some counties have them online.

If I can get a copy showing that she agreed to medical coverage in lieu of alimony do I still owe alimony?

Maybe...but since you have not provided medical coverage either, you are still in contempt of court...and may be on the hook for her medical expenses, which may be much higher than the 800.00 a month.

Its critical that you get your hands on the paper work so that you know exactly what was ordered.

Quite frankly, I am appalled that you don't have your original copies right in front of your face.

I know I should have kept better records but I've had some personal issues. I have tried to get her medical coverage but keep getting declined due to her health issues.
