Question

Paying for Health Insurance for Ex-wife


What is the name of your state? Colorado

My divorce decree states that I must pay up "to the maximum amount of $200.00 per month" toward health insurance "which is comparable to the parties' current coverage" until my ex-wife is eligible for Medicare coverage. The decree also states "both parties shall be soley responsible for obtaining whatever health insurance he/she wishes for themselves.."

My question is: does my ex-wife need to show "proof of insurance" so that I am able to know that she does have coverage and that it is not less than the amount I am required to pay?

That is certainly a reasonable request. However, if she chooses to obtain a high deductible policy that is not equivalent to the current coverage...then I suspect that if the current coverage costs 200.00 a month that you will still be required to pay 200.00 a month, and she can bank the difference to cover unreimbursed expenses.

Its even possible that if she is willing to risk being uncovered, and bank the 200.00 a month to cover medical costs that she might be allowed to do so.
