Question

proof of incom


What is the name of your state?Ohio
My friend is getting divorced after 25 years of marriage. To determine spousal support the court needs his wife's income. However, she has gotten a substantial increase in salary this year that will not show on last year's income tax. She works in the accounting department of her business and he is afraid she will "doctor" the reports she submits. Is there anyway to get documents to prove her income that she hasn't had access to?

Does your friend have an attorney? Can you spell IRS? Can the attorney spell SUBPOENA?

"Yes" to all the questions. However, lawyers are hard to get to return calls. Also, he is worried that she will only turn in last years returns, which I have already said were much lower than this years will be. And he is afraid she will not show her true income if she is the one having to gather the information for the courts.

Remember that word SUBPOENA? Isn't not JUST for her. There is someone at the corporate office who has access to payroll records. THAT is the person to serve a subpoena duces tecum (for the records) on.

Thank you for your advice. I am sure my friend will feel much better now. Of course, this is his first divorce and he isn't sure how the system works. Thank you for being on line to help others.
