Renting the house to ex


What is the name of your state? OR

Is it possible to allow an ex to occupy the marital home if it has been awarded to the other spouse but to include a "rent" amount in the spousal support and then deduct the rental income/loss on Schedule E?

If you want to rent the house, go ahead, but make sure it's for fair rental value if you plan to take any deductions on your Schedule E.


Just pay the Spousal Support the way it's supposed to be paid, and you can take it as an adjustment to income on Page 1 of Form 1040.

Treat these transactions as separate, or the IRS will eventually find out and you'll have problems.

Thanks for your answer.

OK, alternatively, if an ex-spouse is allowed to live in the house and there is no rental transaction, does the other person who is paying the mortgage get to deduct the mortgage interest and property taxes on Schedule A if he doesn't live there?
