Question

Sapenas

What is the name of your state? Michigan

I have been divorced for 5 years. This past March my ex and I took our case out of the friend of the court. At that time he was paying weekly and seeing his boys. I asked for extra money in August for a sport the boys were going to join. I never received any money for the sport. I filed a motion to re- enstate of child support case in Nov. On Nov.15th the case was in-enstated at the amount it was when we took it out of the court. Which was $200 per month. A determination hearing is to follow. My ex was sapose to start paying the friend of the court Dec.1st. On Dec 6th an income withhoding order was served. Unfortinatly he works for cash. He claims that he only made $10,000 last year. He is employeed at one company, is a partner at another and does business with another. He makes money from all three companies. His wife is emplyeed full time as well. he bought his house on a land contact and owns 3 vehicles, 3 dirt bikes and an ATV. How can I sapena his personal financial records? Can I sapena the companies he does business with?

Come on...that's a darned hard word to spell correctly...many educated people get it wrong....and just try to get the correct spelling at www.webster.com....lol.

In any case I just discovered that I have ALSO been spelling it wrong for a long time. Its correct spelling is: subpoena. I have been leaving out the "b" for a long time and no one ever corrected me...sigh.

Stealth!!!!! how did you let me get away with that?????

His wifes income has no bearing on your case. She is not one of the parents and is not obligated legally to support kids that are not hers. You can subpoena his bank records. To subpoena every business he does business with is a little insane and I doubt a judge would even entertain the idea.

Easy - I get called a bitch when I correct people too often. It hurts me. I'm sensitive that way.

I agree with Veronica. Is there any possibility that you could involve a vocational specialist to make a determination of his earning potential since you've been trying to get and collect on a modification?
