separate maintenance

My husband has been appointed guardian of his mother who has alzheimers and is in a nursing home/assisted living. Her husband of 23 years is also in assisted living with parkinsons. He receives a sizeable monthly military pension. She receives a very small social security check monthly. He also has (had) substantially more assets than she. His daughter is his power of attorney and we have reason to believe she has liquidated his assets to her benefit. Their house was sold without our knowledge or ability to retrieve her personal items (prior to the guardianship). He has told us that he is not willing to pay for her care any longer. We are considering filing for separate maintenance on her behalf. Do we have to get an attorney to do this? What would be any possible negative side effects? Any other advice?
