Question

Separated and divorce in process


What is the name of your state? TX

My husband and I are separated and have been for almost 3 years. I have recently filed for a divorced, the divorce will probably not final for 60-90 days. He was named the beneficiary of his mother's life insurance policy, who has recently died. Can I take him to court for 1/2 of those proceeds? This man has been a walking nightmare in my life. I'm not trying to milk him, I just want what's fair.

Sure you are.

So, what's fair? You really want half of the life insurance from HIS mother's death? How do you defend this position? She's not your mother. You had no loss.

If he an show that the life insurance proceeds are part of his inheritance from his mom, you aren't entitled to a penny.

You're entitled to your opinion, but that' not what I asked for. I'm asking legally am I entitled to half of it. You don't know me and I don't know you. I have two children to take care of. I don't have explain my life story or marriage to you. I would just like fair answer to the question posed.
