Seperation Agreement binding for divorce?


What is the name of your state? NC

Can Seperation agreements covering child support and sposal support be binding for the divorce? I am wondering if we can agree to the amounts during the separation and have it binding after the 1 year seperation is complete. Or do we have to deal with the amount of the payments all over again after the 1 year seperation?

Most of the time agreements in a legal separation will carry over in the divorce, unless there have been material changes in circumstance, or unless the agreements were specifically designated as "temporary".

You might need some specific verbiage to ensure that the contents of the agreement survive the divorce, but IMNSHO, that should be fairly standard verbiage.
