SHE Cheated!!!


What is the name of your state? NY

She cheated on me. I have proof. Will I owe her alimony? I understand that the courts are pro-women and I was wondering if I will have to pay her alimony when the divorce is final.What is the name of your state?

No one can predict the future. There's a zillion factors you haven't covered.

What kind of "proof" do you have? And do you have the $$$ to pursue this case in court?

Despite what you may hear here, the courts are NOT pro-women. We don't know how long you have been married, and what your income disparities are, so no one can possibly tell you if alimony is a possible issue. We also don't know if the type of proof that you have is sufficient to grant you a "fault" divorce, and that is the only situation where adultery would factor in.

If she is employed herself, and making a living wage, alimony might not factor in at all. If your marriage is short term, alimony might not factor in either.

Go get yourself a consult with a local attorney and lay everything out on the table. That will give you the best information as to whether or not alimony is an issue in your case.

Very true, plus NY is NOT of the States which BAR by statute alimony from a spouse who committed adultery. And, although both NY and NJ (who seems to have similiar laws + family court decisions) have a provision for "marital misconduct" as one of the factors considered in the award of spousal support and/or property division, recent case law does not prove that adultery, in and of itself, much of a factor.

You really need to lay all the facts out to a local attorney as already advised. Keeping in mind that the cost of getting a "fault" divorce vs a "no-fault" divorce generally benefits the attorneys vs either of the individuals getting the divorce.
