Spousal Support


What is the name of your state? california
my former spouse is 7 months behind in spousal support. he owes me $1800 in arrearages. it was being paid through wage assignment from his job before he and his girlfriend were fired from their jobs for having an affair. he was her supervisor. he says that he is going into business for himself. i think that he is evading support using the excuse of unemployment. he just sold a house and netted over 50k. i am planning to take him back to court. what is the interest rate i can charge for delinquent support. what are co-habitation laws? he lives with his girlfriend who is now employed but he is using a bogus address so that it won't appear as co-habitating. thank you very much.

My response:

Assuming that you've had your Order reduced to a Judgment, then interest is 10% per annum. California doesn't care one bit about cohabitation - - so, if he thinks California does, then he's fooling himself.

thank you for the reply i am always liable. i didn't understand what you meant: reduced to a judgment and that california doesn't care about cohabitation. i do have a judgement ordering him to pay support for 24 months or until death or my remarriage, whichever comes first. i haven't received payment since june. what is the law on cohabitation if he isn't working? thanks again.

Cohabitation has no bearing in this case.. whether he is working or not.
