spousal support


What is the name of your state? il

i am married to a veteran who gets his finances from the government. i would like to know what is my legal right to spousal monies from his benefits. he is very abusive from drugs/alcohol and he pays a little of the bills now. we have a home and i would like to know what my legal rights are as his wife for benefits since i'm not working and i have a disability which causes me not to work right now. he says he doesn't have to give me anything is that true or false? when the house was bought i was working and i bought due to my income because his was not enough at the time. now he gets close to $4,000.00 a month and he says he doesn't have to give me a thing. i'm looking for a way out of this relationship can you please tell me what to do. thank you in advance.

Disability benefits are protected up to a point. Now if he is getting a benefit amount and you have been married for at least 10 years, you are entitled to half.

Is the house in your name or both? You need to ask an attorney in your state on this matter.

You say you are disabled. Are you collecting social security benfits and if not why? Have you applied? You should if you haven't. They usually deny you the first time and then you appeal and go to court. This usually takes about 11 months.

(Personally, I'd stop paying the bills. Either he will pay them or he will move out when the lights get shut off. When this happens, see an attorney and get an injunction or restraining order (if he is abusive when he drinks) to keep him from returning). Then you could get a divorce on the grounds of abandonment.
