Spousal Support


What is the name of your state? CA
I was married 3 yrs 2 mos, separated sept 2002 got back together month later after her affair with a so called friend of mine, split again this sept. for same reason. divorce papers have been filed, she is asking for spousal support, is she entitled when she makes pretty much the same as I. We have no kids and both are back at home with our parents. There is a about 7k in community debt I have no prob paying, but not to her, to the creditors I will. Please advise

Was she working while you were married? If so, tell her to wrap her legs around this...(fist in the air).

Spousal Support is for a spouse to be made whole. In other words, if she had never worked (or given up her career) outside the home then she would be entitled to support up to the time she could be made employable and self-supporting.

Unless you have a judge who is a total non-feminist or an old fart drunk, her chances are highly unlikely that she will receive any support.

But then, you never know.

We both work and make pretty much the same, I know she at least brings home 85-90% of what I bring home and like I said we both live at home with our parents now, only thing is she took the good vehicle and I had to get another car because my truck gave out a month after splitting up.
