spousal support


What is the name of your state (only U.S. law)? ny
yes i have an order of protevtion against my husband for domestic violence he was paying all the bills including the mortgage and car insurance and i've found out he no lnger is paying any of thse things so i got a petition for spousal support and i o to court on 10/10 he won a lawsuit in 1993 and sold some of his payments in 6/2008 he received with my help the sum of $115,000.00, he is ironworker and makes $100.00 an hour, collects unemployment and also get social security $1400.00. i make $470.00 a week before taxes. i have a daughter who is not his that is a way in college i took out a loan so that she could continue her education he paid for her 1st year and the union reimbursed him for $22,000.00. i don't have a lawyer to represent me so i was wondering how do i handle this case

Well you have your court date, what else do you need?

You need to punctuate your post. It is difficult to understand as written. Here's what I think you've written. You had a restraining order placed on your husband. He continued to be responsible for all marital expenses. He stopped paying them.

You filed for spousal support or divorce? I'm thinking divorce> And you go to court on October 10. Is that right?

He won a lawsuit - did you sue for loss of conjugal rights, etc or was the suit completely in his name?

What do you mean he "sold some of his payments" and with your help received $115,000? Are you referring to his lawsuit? Was the award to be paid over time and instead he signed a portion over to receive funds immediately? Not sure but thinking that is what you mean?

He collects unemployment and social security? And is an actively employed iron worker? Or he formerly was an iron worker and now is on social security due to being disabled or injured on the job? Or he's typically an iron worker, is currently laid off, is receiving unemployment and collect partial social security? Huh????

The you took out a loan for your daughter to go to college and he paid for it? He didn't have to - she is not his responsibility. But then you say the union reimbursed him for $22k...reimbursed him for what exactly?

And did you have an actual legal question?

I did not see where he was ORDERED to pay those expenses, she only stated he HAD been paying all of them. WE do not know that he is legally ordered to cover everything for her. Only that once no he was longer residing there, he stopped paying her expenses.
