Spousal support


What is the name of your state (only U.S. law)? CA

My ex had wages attached years ago to comply with support payments. He was keeping spreadsheets and mailing weekly to me. I never keep records, only saved pay stubs. He recently informed me he has overpaid a large amount of money - three years worth and is now going after me for this, claiming it was both of our responsibility to "monitor" the payment. In checking I agree, he did overpay. My contention is how did he not know that for 3+ years he was overpaying and now going after full payment. If this is the case, and nothing can be done, then is it possible since he's claiming it was a mutual responsibility to "monitor" that I should only be obligated to repay half? Also, he never complied with court orders in final decree to sell certain items to pay debt down quicker.

My ex is now repaying my prior overpayment amount by $100 per month, until it is payed off in full.

Regardless of who's responsibility it was to monitor the payments, once the overpayment is noticed, it should be remedied in full.
