You cannot sue him in small claims court for a family law matter. Small claims does not have jurisdiction to hear the case. It needs to go back to family court and you need to file for contempt.

The court fees aren't expensive, however, your attorneys fees may be expensive.

Do you intend on firing your attorney? If not, you cannot file anything on your own behalf.
