Spousal Support for disabled


What is the name of your state? Florida
Hello .. I was married 1/1/05 and in feb of this year i became disabled with no means of support. my husband and i have no children or property purchased together as a couple and he lives in another country. we have filed for divorce and i am in need of some kind of support from him until my Social Security Disability is approved. Can i get support from him ?

Just a question:

under the same disability, same circumstances: what would you have done to support yourself if disabled if you HADN'T married him 1/1/05? If you had still been single?

Have you applied for welfare? Did you have short term and long term disability insurance at work before you became disabled?

Hello no i have applied for Disability,and no insurance what so ever i have alot of health problems now as of feb of this year i was marked as totally disabled due to these problems i have. and i dont have any means of support right now

I was not disabled when i married him in 2005 i was a Nurse working 12-16 hours a day 5 days a week and he was not working up until 5 months ago. he left me and went to holland where he is from.

Are you saying that you worked as a nurse, but didn't have STD and LTD insurance available? Or that you didn't purchase it? Did you apply for welfare? Do you have savings? Are you also saying that for the time you lived together, he didn't have a job?

That is correct i worked as a private nurse where no benefits was available.i have a small savings ,he moved back to holland,and he is working there i just need to know if i am eligable for help from him until i get disability

Did he have a job while you 2 were together? You'll spend more money trying to collect support from someone who lives in another country. Also, you weren't married long enough for us to expect a judge to require it.

Not after such a short marriage. No. If you are still married he may have a legal responsibility to provide for you HOWEVER it will not be a lot of money that you would receive if any because he would have to be served and you would have to go through court. And it would count as income which could hurt how much in disability you would receive.

So when you were working, before becoming disabled, WHAT ST and LT disability insurance were you carrying? Surely getting married doesn't change the need to have disability coverage. ESpecially, if he had not been working most of the marriage, you obviously were not depending on his income - he was depending upon yours.

What were you carrying in ST and LT disability BEFORE this very short marriage? Why can't you fall back on whatever you would have otherwise fallen back on had you not married him and become disabled?

If you read the previous posts i was a private nurse with NO ST or LT disability insurance nor health insurance it was NOT available. .. no he didnt work the entire time we have been together up until 5 months ago

The statutes do leave the possibility open for some form of temporary support because you are now disabled, even though your marriage is short.

Do you have an attorney? If so, ask them about filing for temp support. If not, you can file for it yourself. It's worth a try and the worst that could happen would be a denial.

H lives in another country. She can't possibly get the order enforced without an attorney-and she doesn't have an income.

Even WITH an attorney enforcement could easily be far more expensive than any support she might collect....and it might be impossible to collect.
