Spousal support ends, is it forever?


What is the name of your state (only U.S. law)? Ohio

My divorce decree states that if my ex remarries or cohabitates spousal support ends. She just informed me she is moving in with her boyfriend so I can stop support. She is walking away from $66,000. The decree does not state that stopping support is permenant, if she breaks up with her boyfriend down the road can she go after support again? The decree reads "support in the amount of $1,000 monthly for five years". I sent her a letter that she has agreed to sign the states she is giving up her right to any "future support in order to exercise her right to cohabitate", would this letter hold up in court or do I need to have the court modify the decree. If it matters the support money does not go thru any agency, I deposit directly into her savings account.

You need to file to terminate spousal support in COURT. And once it ends it ends.

Spousal Support Ends ??


In 2003 I was orderd to pay support for a marraige which took place in Pennsylvania. My spouse abandoned our home while I was at work. I have never received either separation papers nor divorce papers. In Nov. of 2007 I received notice from Alleghney County ( PA ) that my QDRO was terminated because she had failed to file some papers , my pension went up to it's " normal " amount.
In March of 2008 I received an order from the state of Ohio ordering a new QRDO , but the amount of my pension remained the same until October , 2008 . I requestd a hearing and was not granted one . . . I was told that if I protest the new QRDO , I had nintey days before it would go into effect. They began taking the money Immedieately , saying it " was being placed on hold ".
Recently I received a letter from her starting out " Why are you doing this to me ? " Doing What ? Defending my rights ?? I consider this letter harassment.
It is impossible for me to afford a lawyer , my remaining pension and medical problems ( read co-pay here ) don't leave me with much money.
I would also need a lawyer who can practice here in the United States as well as Canada , as she relocated there after abandoning our home.

Ohio Family Services claim that my issue is with Pa , but I have papers from there stating that they have dismissed the case. Even when I attempted to call this to Family Service in Steubenville I was told " not to get mouthy ".
It seems to me that I'll be forced to pay the QDRO due to lack of legal representation , and will be forced to make it public what a bunch of lazy , useless people work at Family Services.
