Back in 2000 is the date of my divorce. In the divorce decree it states the maintenance I pay is contigent upon that my ex-wife cannot reside with another unrelated male or cohabitate with another unrelated male. Back in 2002 I had the maintenance suspended due to it being a financial burden at the time. I tried to have it eliminated but the judge only suspended it until I could deem reasonable employment again. The ex-wife found out that I was getting an inheritance from my mother's death and petitioned the court to get a lump sum this year. What she failed to tell the court is that she is in fact co-inhabitating with an unrelated male and he contributes $1500 a month from workmans comp. The only thing that changed from the original order from 2000 is that the maintenance is suspended. Doesn't the maintenance cancel out due to the original order from the divorce decree with the co inhabilitation? It also states in my divorce decree that I am to obtain health insurance for the kids. I did until I was laid off and in 2002 put the kids on a state program for health insurance. She took it upon herself to take them off and put them on her own health insurance when I thought all along they had the health insurance I put them on. Just recently I finally with the grace of God landed a decent job and I called her to tell her I would have different insurance. She wants me to pay her $8800 in back premiums that she incurred and I had no knowledge of. Am I responsible for these premiums that she incurred without my knowledge? In 2002 she was ordered by the judge to refinance the first and second mortgage on the home. It has been 7 years and she still hasn't. My credit report reflects the late payments and the bank has contacted me for payment. Can I have the court enforce her to refinance or put the house up for sale to get my name off? I am trying to stay away from my wages being garnished from the house she lives in. Thanks for any help. |
