Spousal Support:Retirement


What is the name of your state? OHIO

My husband's former wife of 28 years recieves 35% of his salary.
He hopes to retire in 3 years from his current job and go for an spousal support adjustment.
In the divorce 1st wife recieved 1/2 of all retirement funds accumulated to date along with at least 1/2 of all assets. She ownered her own business and was able to "reduce income shown".

What will the court assess when establishing a new ammount? I work and have contributed significantly (75%) over the last 9years to what we have accumulated together.

Your advice is appreciated

To some extent it may depend on her ability to collect social security, combined with what could reasonably be expected from the 1/2 of the retirement funds she recieved. I would assume that if she recieved 35% of his salary as alimony that she probably never worked and therefore never built up any SS benefits.

Does the order reflect anything at all about what might happen upon retirement?
