Switching to pension?What is the name of your state? NJ Settlement read alimony until exhusband retires. Ex wants to retire and offering a lump sum to close alimony payments. He has 3 years to go before his 62nd birthdate. He states I will receive 1/2 his pension as soon as he retires if he retires now. I'm only 55. Is he correct or do I have to wait until 62 to receive pension benefits. I don't see anything written on divorce decree referring to pension benefits after he retires. | Also, it is legal to retire before 62, it just means one waits before the SS portion is available. If the decree does not establish any provision for retirement before SS age, then he is probably free to retire whenever he's ready.
