urgent spousal support


What is the name of your state (only U.S. law)? Texas
my husband is earning 65 to 70,000 per anum and yet he is not supporting financially me n my 2 kids aging 3 yrs n 6 months....i'm here in usa on H4 visa and my child is american citizen.my husband is on H1-B visa and he has moved to illinois leaving me n kids in texas...without any valid reason,he is just forcing me and kids to go back to country n live with his parents.he remains under the influence of alcohal. he has stoped giving us any money for food or medical.my 6 months old son is very sick...he's having allergy problems due to his family history from his father side.i'm living with my far family relatives.
i have very good impression of america..that there are equal rights for women here.please help me in acquiring my legal rights in america....i can not work here due to my dependent visa H4.
is there any moral ground through which i can work and support my babies?and how can i get alimony and spousal child support?also my husband has filed green card application..which is under process.What is the name of your state (only U.S. law)?

Unfortunately your H4 status limits you a lot in terms of what you can do to support yourself. You can't work legally unless and until you change status. Though your child is a US citizen s/he can't petition for immigration benefits on your behalf until s/he is an adult.

You NEED to speak with an attorney, and quickly - preferably one who is familiar with family and immigration law. And try posting in the Immigration section here, too

(don't normally advocate posting in two places at once but this time I think you should go ahead and do just that)

I'm sorry I couldn't be of more help. I'm going to post back in a minute or two after I find some low-cost/Legal Aid in Texas for you, k? If you do read this, could you indicate roughly where in Texas you are?

I 'm in Houston ,Tx.by education i'm a qualified engineer..please can u tell me how can i change my visa status to work legally??also i'm eligible to file case in usa court??if yes.then what would be the cost or conditions??also do i need to regster my wedding in usa to file a case?what are my chances to have spousal support or child support from my husband?also how can i proof that we use to live together after marriage always...and all of a sudden he just left us....just left us!!

You would need to obtain an H1 or other work visa of your own.

If your marriage is recognized in your home country, generally it will be recognized in the US too. If you have met your state's residency requirements you should be able to file for divorce in that state and decide custody, child support, alimony as part of the divorce.

Again, I think you need an attorney to help you with this because of the immigration concerns.

I want to know..is USCIS...offering H1-B visa for the year 2010?or i can get a job first and then..they will apply for my H1-B visa?

Generally you would be offered a position first and the company would sponsor your H1b visa.
