What am I entitled to?


State: California

I have learned that my husband has been having an affair since 2006 (he accidently left his e-mail open on his laptop - yes, I saved them). He has since confessed to multiple infidelities throughout our entire marriage. He has moved in with his mother, while I decide what to do. Obviously, I'm considering divorce or at least legal separation (to avoid losing health insurance).

We live in CA and have been married 19 years. I have never worked during the marriage. I was still going to college when we got married, and got pregnant soon after graduation. I have a BS in Business Administration. I only have about 3 years of work experience, which occurred before I went to college. We have one child (age 16). He wants to give me full custody and has not asked for visitation (he wants my daughter to decide when/if she wants to see him). He makes $120k+ bonuses (varies). We have a $2,000/month mortgage, and our daughter plans to go to college.

What is the maximum percentage of income for spousal support (not counting child support), that I would be entitled to? With this economy and my lack of work experience, finding employment is not going to be easy and I doubt my earning potential will be very high.What is the name of your state (only U.S. law)?

THere's alot that needs to be considered.Daughter will be 18 in a couple yrs.Therefore she will likely (or should be )independent tio some degree.So long term child support won't be an issue.Will you be buying him out of the home or vice -versa.Surely he can afford the payments so it would be wiser to let him hav the home .You will receive half of the curent equity and then can look for a place you can afford.You will need to get some kind of job.The court will inpute wages to you anyway,They will see a college educated person with nothing to hold her from working even a job like a restraunt..Perhaps a receptionist at a medical office,There you may get your medical benefits.Your daughter is far too old to be considered a reason not to work.In fact she may already work like other young adults do.You may get a few months of maintenance to help you find a job or go to a class or two.
California ,the great libral state it is ,is PRO-WOMEN.They want to get you gals I mean ladies on the road to success.Not sitting home eating bon bons watching soaps.Its a new liberated world and your in the right place to get on the road to prosparity.Think positive,fight for the big company jobs.You may need to start small.But there are tons of jobs out there.If you cant find one I bet the judge will help/ Good Luck
