What do I need to prove someone is not co-habitating with me?

What is the name of your state (only U.S. law)? North Carlina

What do I need as far as evidence that someone is not co-habitating with me? I know he needs to prove it. But what evidence is used in this situation?

Not co-habitating with me? or co-habitating with me?
