Is it worth going to court over alimonyWhat is the name of your state? MI Is it true that if one goes to court over alimony and the Judge awards it, the person receiving it can always come back every year and petition for another year of alimony. But if you settle out of court,on a certain amount of years of alimony, this person can never petition the court for more. It's a done deal. Thank you Emma |

| I don't think so. A judge will "award" a number of years of alimony and when that time frame is up - it's up. Period. Now, if there is arrears involved, it throws a whole new ball of wax into the fire.

| DON'T "just agree" to avoid court! We had a guy here who ended up paying lifetime alimony in a really short marriage who probaly would not have paid any if gone to court over it. GET AN ATTORNEY and don't take legal advice from your ex or their attorney..,

my attorney told me....My attorney is the one who told me, if I go to court over alimony (I have full custody of the kids and he is wanting me to pay HIM alimony because I make more than he does) and if the Judge awards a certain number of years, or even one year of alimony, my ex has the right to come back EVERY year and petition for more alimony. From what I've read on this site, that is not true? Thanks. |

| It's likely both state and situation specific. Why would you believe what a bunch of invisible people who know nothing of your situation over your attorney who knows your state's laws AND the whole story?
