19 year old charged with a first time petit larceny PL 165400 in New York City


I was arrested in New York for stealing $360 worth of merchandise from Urban Outfitters and have been charged with petit larceny. I've never been in trouble with the law before and I was wondering what punishments I would be facing. Could someone please explain to me what a adjornment in contemplation of dismissal is and how i could go about attaining it? Is there anyway I can have the misedemeanor charge changed to disorderly conduct? Would that be better or worse? And can someone please tell me what certificate of relief from disabilities is? Or a certificate of good conduct? I'm not sure what to do here, and I'm not sure if I have the resources for an attorney. All help wold be greatly appreciated. I got to court in a month and I have no idea whats going to happen. I'm really confused and scared so any of your input would be helpful. Thank You

Where is your Public Defender .

If you don't have one and can't afford one , one will be appointed by the Court .

If you can afford one ( or ineligible for a PD ) , then you either hire one or go on your own .

Probation with restitution seems appropriate .

BTW , you're way in over your head and the questions you ask , to represent yourself .

You do not qualify for a public defender, your charges do not include jail time. Petit larceny is a class A misdemeanor. You are looking a at fine and probation. You will also receive a letter from the retailer demanding up to $500 as a civil penalty, this is on top of any fine the court hands down.

No qualify for a PD for misdemeanors ?

Right idea, wrong application.

If jail time is not POSSIBLE, then no lawyer. If jail time is possible, but simply UNLIKELY (like here) - you are eligible for a PD.

Thank you all for your input. Now that I have an idea or so of what might happen, I'm less hysterical than before. Based on your advice I'll be looking into getting a lawyer as soon as possible and if I don't have the resources for one than I will look into a public defender. Again, thank you all, it was very much appreciated.

I had a friend with me


I was charged with petit larceny for 2 earrings and about 10 tee shirts for my friend who was with me while i was at the store. The earrings were for her and the tee's for her boyfriend, however, she never took anything. She wasn't questioned or stopped at the store but the cops asked me if I was alone or not. I wasnt read my miranda rights and in the panic forgot that I didn't have to answer. I told them I was with a friend, and when asked who some of the things were intended for, I said for my friend and her boyfriend. I took a sweater and three tee's for myslef, seeing that 2 of the shirts were doubled in styles and obviously for men, I think it was obvious that the items were intended more for others than myself. I don't want to involve my friend in this but seeing as that I have to tell the truth to the courts I may not be able too. Is there any way that they can charge her for anything? I never gave the police officers her name but I'm scared they might ask once I get to court.
