7 years really?


What is the name of your state? Arizona

I posted before asking about my buddy who was arrested and received 2 charges: posession of marijuana (under a gram) and drug paraphornilia. It has been almost 2 months since his arrest and he hasn't received anything in the mail reguarding the charges or a court date. His lawyer said they would either "push it under the rug" or he would recieve something in the mail to enroll him in the TASC program. From my undertstanding, the district attorney has up to seven years to press charges. How long does it usually take? Does it really take up to seven years? Also, he is moving soon so how does he change his address with the court system? Thank all of you for your help.

In Arizona, I've seen charges filed as far as a year after the incident.

I could be mistaken, but I believe updating the address with the MVD should take care of it.

Thank you for all of your helpful information... Since he was charged with these 2 different charges (the possession and paraphornilia) will he still have the opportunity for the light probation as well as having both the charges dropped with successful completion?

That's up to the DA, but my guess is yes, deferred prosecution will be offered to him.

Also, he is an Arizona resident yet he goes to school in Maryland. When the officer arrested him he asked him what school he went to and if he was a student.. Does this change things at all or make it any more likely for them to drop the charges? Do the offer deferred prosecution out of state?

This does not affect the odds of the case being ropped.

Whether or not the probation will be allowed to another state is up to the PO and the courts.
