What is the name of your state (only U.S. law)? TN
my husband is being accused of stealing tools from his previous job. There were at least twenty different people who had access to these tools over a two year period and five of which had master keys. He does not have any of the tools. He has a similar set bought years before he started the job. The previous employer is threatening criminal charges.

Has your husband just left this particular job? Has he filed for unemployment against this employer? Or has he left, been working somewhere else, and suddenly the old employer is calling and accusing him of stealing the tools? Two very different situations.

If your husband has another job now, and the employer is threatening him, all that the employer can do is file the charges if he wants to. Then things will go forward from there.

If your husband has been fired from the job, or let go or quit recently and the reason all this is going on is that he has filed for unemployment, this is another issue entirely. If the employer does not have enough proof to file criminal charges, and your husband is completely innocent of stealing the tools, then this is a threat supposed to keep him from receiving benefits for which he may otherwise be entitled.
