new york state, i got aressted for criminal impersonation in the first degree in 1998. nys penal code 190.26. in actuality i was not impersonating a police officer but that is besides the point. the judge issued me a six month acd. it has been 4 years now and i was applying for army ocs. i am eligable in every which way except they found this acd. they said that i am guilty of a felony. i thought that this charge was dismissed and nobody could hold it against me. this is the only time i have ever been in trouble with the law. how can the army do this and if i am guilty in their eyes, how can i appeal the charge and get it reduced? i did some research on what exactly artical 190 section 26 says and i know that if i was in court it would have to be reduced because there was no predicate felony.
