Any rights to impounded vehicle in ongoing investigation?

What is the name of your state?
Ohio
Son involved in auto accident more than 3 months ago resulting
in near fatal brain injury to his passenger. Not cited or charged
currently but auto still impounded for investigation. In the meantime, our insurance carrier still cannot assess and we cannot
move forward pending any criminal charges. Investigator does not return phone calls and we have received no information what-so-ever. Do we have any recourse or rights? Is there is limitation
on how long they can keep the vehicle impounded and will we be
responsible for impound charges?

Evidence can be kept for as long as it takes to perform an investigation, this can take a couple of years sometimes. You will not be responsible for storage costs.
