What is the name of your state (only U.S. law)? florida

My husband was arrested this pass saturday the warrant stated non payment of child support / contempt of court..He has no order for child support..the real reason he was arrested for failing to appear in civil court for a debt..but the arrest warrant states non payment of child support..was told by the judge that it was probably checked because there is no where else to mark it..now he is listed on sheriff's website if you look him up as non payment of child support..was it legal for them to draw an arrest warrant under non payment of child support? this is going to follow him..thank you for any and all answers

Several things do not make sense. He was ordered to pay support and did not (contempt).

A warrant does not get issued for the wrong reason just so a warrant can get issued. "No other place to mark it"?

That is not how these things work. For a warrant to be issued that is knowingly false is illegal.

He was never ordered to pay child support. We have been married for 26 yrs and have 4 children. Which he has always taken care of. The warrant should not have been made out for non payment of child support. Even the judge said this. He was in contempt of court for not got to a hearing for a repo"d truck that he had co signed for his brother, and yesterday during the hearing this is what it was all about. The warrant he was arrested on was wrong.

Wow, sucks that the warrant was wrong. But, look on the bright side. It was that much easier for him to deal with his contempt issue! :cool:

I see. It seems like he should have been released on that warrant. A small civil demand may be in order. goodluck.
