Arrested due to Computer Error. Georgia


I was stopped in the city of Cave Spring for excessive acceleration. I didn't have proof of insurance (I HAVE insurance, I just didnt have PROOF of insurance or the little card thing they send you)

I was written a ticket for driving without proof of insurance. He didn't take my liscense, he didnt tow my card or take me to jail.

I show up on the court day, present my proof of insurance and pay the reduced fine because I proved that I had insurance at the time, I was just without proof.

I thought it all ended there, but a few weeks later I was pulled over in Rome Georgia for not having my headlights on. (I was glad I had proof of insurance this time) After I spoke with the officer and he went back to his car, he approached me and informed me that I had a suspended drivers liscense because cave spring entered my ticket as a driving WITHOUT insurance ticket. I was arrested and taken to jail, I sat for a few hours before my dad could get all the nedded information together and got me out. In the end, I paid 13$ as a booking fee and 192$ as a bonding fee. that's 205$ that I had just lost through no fault of my own.

I was pronounced not guilty and was given my license back the very same day after I called cave spring, and they realized what happened.

I sent a letter to cave spring requesting that they pay me 205$ because it was their fault I was arrested. They sent me a letter back saying they were not liable for the incident.

Thoughts?

A responsible person, after receiving such a citation, will contact their local DMV, MVD, BMC (whatever you have) and make sure there is nothing wrong with their license. My guess is that the state is not entitled to pay you anything, and that they will indeed choose to not do so. On the other hand, it doesn't hurt to ask.
