arrested for mip

me and a friend of mine were going over to some other friends apartment. when we got to the parking lot the cops pulled up behind us and started flashing their lights. they wernt after us but they still arrested both of us, him for dwi and me for mip. the think i dont get is how can they arrest me for an mip when the beer was behind the seat of my truck with no way of getting to it with out stopping, and my friend is over 21 and said the beer was his?
