Question

assault question

What is the name of your state? Michigan
Son is non-custodial parent in cps case ongoing for the last year. There was a hearing this past week, sons attorney could not be present and son was allowed to dismiss until another date. After hearing there was a problem involving daughter in law. Son was passing caseworker involved in his case and asked that "what she saw not leave the building and that he would see her in court. " Next hearing is in two weeks. Caseworker filed assault charges against son, she states he said he knew where she lived and he would see her later. There were sheriff deputies who heard remarks, but did not see a problem as son did not threaten the case worker. He received a call three days later from someone saying they were an investigating detective,no name given, he asked what had happened the day before, son stated he had went to work, they discussed what he had said three days earlier, son reiterated what he had said . Person on phone continued to ask over and over again what happened, son repeated his side of the story, person on phone asked if he wanted a warrant right then, son said he did not, person on other end of phone stated he would contact him in few days after sending info to prosecutor and let him know if they will pick him up or if he can turn himself in. Son is scared to death he has never threatened anyone, has no criminal record of any kind and is trying to gain custody of his child of his child for the last year from the state, they have now let mother and stepfather plead no contest and will not press charges, he is not sure what could happen to him or why this caseworker has decided to do this to him. Is it practice for sheriff deputies in Michigan to not give their name when they contact you? We are prepared to get attorney, but we do not have much money. Also should be mentioned that same caseworker filed a complaint against the mother involved in this case for stalking but did not press charges. What can happen in a case like this ?
