Bench Warrant


What is the name of your state? Washington

Greetings,

I plea-bargained down to 1st degree negligent driving in a case after overturning a jury trial [constitutional violations] for DUI and possession. The court then imposed a fine, which I paid, the court also mandated a 1 hour class plus a 6 hour DUI victims panel class which I failed to attend as I had moved out of the country to St. Kitts in the Caribbean and had since become aware that a warrant had been issued for my arrest for failure to comply [I assume for the 2 classes].

I have no intent to travel back to Washington but do have possible intent to travel back to Florida periodically for supplies or items that can't be obtained in St. Kitts. I don't wish to be extradited to Washington over this trivial matter.

After learning of this warrant, I wrote the warrants officer a letter explaining that I now lived out of the country and had no intent of returning and ask what I could do to clear this matter up without having to travel back to Washington [pay money or whatever]. I have received no reply from them after 5 months and am asking if anyone here has any recommendations other than traveling to Washington and going to court over the warrant.

You can either remain out of the country forever as the warrant will never go away and you MIGHT be arrested upon your return (though if WA would extradite you is questionable). Or, you can hire an attorney to try and deal with the matter.

Can the court simply accept payment in lieu of other process? Or some other compromise?

They might ... but it depends on the nature of the offense and whether it requires your booking or not. Your best bet is to hire an attorney to look in to the matter. It may be able ot be resolved that way, but chances are you will have to appear at some point.
