| residing in virginia, someone broke into my home in september. police know who it was, they talked to the kid's parents, who told the police we did not want to press charges, but the police never came to us to even ask. it is now almost february. what is the statute of limitations on breaking and entering. is it possible that we can still press charges? |

| What I suggest you do is contact the police department and notify them of you intent to pursue this matter. It is always possible that the police did their job and turned the matter over to the DA, who decided not to prosecute. Yes, there is a statue of limitations - which you can locate by simply checking in your state's penal code under isdemamenor and felony - you can find out how long the state can file. |
