Brother Accused Of Child Pornography


What is the name of your state (only U.S. law)? NY

My brother downloaded child pornography off of limewire accidently when trying to search for something and decided to download everything off the page and came along with it. Considering it was in the basement of a karate school and the previous year there was a karate person who physically molested the children my brothers case was hugely blown out of proportion. After $100,000 in bond and $8,000 in lawyer fees were practically broke. We knew a fairly good criminal lawyer for many years but doesn't know ANYTHING about computers. Will this hurt my brothers case at all even though hes a good criminal lawyer but doesn't have any knowledge in computers.

Ill take any advice I can take at this point (any points about limewire usage anything!)

Don't use Limewire or any other file sharing application to download anything. They are usually virus- and/or spyware-ridden. If he had been downloading/sharing MP3s, he could be busted by the RIAA who lives to sue people for pirated MP3s, and if he is downloading/sharing 'warez' and/or cracks/keygens, he could be busted by the SBA & the FBI for software piracy. None of these have pretty outcomes...

Who owns the computer? Are there logons/passes required to use it? Whose account was being used? Who has access to the computer?

My Brother. No. My Brothers Account.

He lives alone in a basement, so he mostly uses it but his friends and I use it from time to time.

Then his friends and you could also be arrested.
