can commonwealth atty. give flase evidence in court?


What is the name of your state?virginia

I went to court on a misdomenor of attemped petty larceny,the da said she had a tape of the incident and she even had 2 tapes in front of her,then her witness lied about the facts and told the judge i was arrested in the store(which didn't happen)so based on what she said and the da saying she had tapes i was found guilty and got 8 months,we appealed and go to court march 2,now we know that she(the da) expected to get tapes but didn't and never had them,can she get in trouble for saying she had them cam we get the witness for perjury?,this is a old warrent i was picked up on and i guess she didn't remember the detailes but it doesn't give her the right to just say what she thinks happened and the da letting her say it and not correting her ,does it?

p.s. my lawyer is an idiot and didn't object to her lying he was just like don't wooy about it we'll appeal!!!! please help with advice
