can they really charge me???

What is the name of your state (only U.S. law)? Rochester, NY

My boyfriend was pulled over and was arrested, in the car was forged instruments. I'm being charged with possesion (I was at home sleeping when this happened) and the making of them. My lawyer told me (Public defender) that they could charge me with possession even though I wasn't in the car at the time. All I know is that they are both class d felonies. And that I'm looking at a 2-6. This is my first time being charged, arrested, or in any type of trouble with the law, can they really give me 2-6?

You can be charged with possession if they have reasonable cause to believe you possessed them at any time, not just at the time of the arrest. If they have evidence to that fact, then you can be convicted. I suspect you could very well be looking at jail time, but without knowing what the instruments were, what they were used or intended to be used, for etc.... we can't hazard a guess. Felonies charges are not to be screwed around with. Listen to your lawyer.

They can charge you with any crime that they feel appropriate and that is supported by the evidence and/or investigation. As for what sentence you might get, depends on a LOT of variables. Start by getting a good LOCAL defense attorney. He/she can review ALL of the facts and help advise you on what options you might have.
Anything other than that is a guess.
