Question

Can you be arrested 3 weeks later....


What is the name of your state? ny

My ex-husband was calling me these awful names three weeks ago, provoking me to slap him, which I did. I bearly made contact, but now that I have served him with an order of protection and am requesting he take parenting classes he said he is going to have me arrested for assault from three weeks ago. He said his son "heard" me slap him, which is impossible because I only got is chin and he has a beard/go-tee. The police station told me they wont act on it, but he said his attorney says otherwise.... should I be worried? It kills me because he abused me during our entire marraige of 15 years, and I barely touch him and he has the b**s to threaton me with this if I don't drop the protection order summons..... what do you think?

I think you're headed for Alcatraz Island.

He's got nothing. If he had anything at all, he would have made a complaint with the police right after the incident.

Don't worry about it - - he's blowing smoke up your dress.

Exactly....


A department that is well managed and has a seasoned crew will not take a report of that nature, due to the timeframe, the nature of the "assault" and the ongoing dispute between the two of you. But be careful in the same breath, I've had cases where the husband or wife deliberately jumped in front of the others car just to file an agg. assault charge against the other, and a whole slew of other unbelievable stuff just to "win" and or dissolve the relationship and get custody of the kids. But don't get any ideas.
