My response:

Yes. It's called "assault" - - but only if you have the "present ability" to carry out the threat; e.g., a paraplegic couldn't be "charged" if he/she threatened to "kick your ass" because his/her legs can't "carry out the threat."

Wrong. It also requires a "present ability" to do harm. Would you like to see the Jury Instruction on this subject?
