That depends ... is it being held as evidence? Is it pending asset forfeiture? Is it simply waiting for the registered owner to pick it up?

Contact the impound yard and see what is needed to retrieve the vehicle. It may be that someone simply has to pick it up and pay the storage and impound fees. Or, you may need a release from the police, the prosecutor and/or the court.

the cop is just being difficult.

carl,
the car is at the police station and everytime we call the cops tells us to call
back in a couple of days,we call back and he doesn't answer our calls.
we wonder how long he can keep it legally. no it is not evidence.
thanks

Ah ... well, if this were CA I could answer the question. Unfortunately, NJ may be a different world. Has your son asked his attorney this question?
