What is the name of your state (only U.S. law)?
CALIFORNIA

I have an assault and battery citation I recieved in June. The date on my ticket says AUGUST 25. I called the court yet again today and they said it is not filed yet.

Is it common for a misdemeanor case like this not to be filed untill right before the court date?

Or does it seem like the case might no be filed since it hasnt yet?

Either way Im going to show up there on that date, but I just want to know from people who have a better idea of how this works.

It is rare that a simple battery case would not be in the system after two months and so close to the court date. But, they have one year to file.

So, you are doing the right thing by showing up to court on the date and time on the citation. Obtain a stamp from the court on your subpoena or citation, and even get the name of the court clerk if you can so you have something to fall back on to show that you were there at the appointed date and time in case something goes awry down the road.
