change of venue in criminal trialWhat is the name of your state (only U.S. law)? Florida My question is in a criminal trial would it be a conflict of interest if the prosecutor and judge are to be witnesses against you? and would a change of venue be granted on this? The judge to be a witness has recused himself but it is a judge in same county.What is the name of your state (only U.S. law)? |

| The new judge being from the same county will not be relevant. These are questions to raise with your lawyer. If you lose your case, your lawyer may be able to get a successful appeal. Oh, and if you don't have a lawyer, get one.
