police came to my house for an accident 911 call
came in
claimed the basement smelled like weed
brought a drug search dog
and cited me
the citation read
basement smelled like marijuana
can i seriously be charged for that

Was there a code section on the citation? There should have been a violation number of some kind. THAT will tell you the specific charge you are accused of.

hmm i dont have it on me
what could i possibly be charged for if no pot was found
an officer had found a tin foil pipe filled with tobacco
no burn marks even on the pipe

Apparently they think they can charge you with something. There is obviously something that they saw that they think they can charge you for.

i assume im being charged for the pipe
but i thought that would be parafanelia?
but the citation didnt mention the pipe...and it was filled with unsmoked tobacco
so i dont know what i can be charged for

Simple as that. They did not find the marijuana, but you had some, and you are going to pay for their time. Yes, you are seriously charged for that, one way or another.
