What is the name of your state? Pa**************.....When a child is in school and is given a paper to fill out about his home life and what goes on in a multiple choice questionaire, or is directly questioned by school authorities, does the child have the right to ask for council. And if he does should one be provided by the school and for by the public defenders office? Also since the child asks for an attorney, should all questions be stopped at that point?

Why would a child need a lawyer to help him fill out a form?

The answer to all of your questions, based on the facts of your post, is no.

Happened to someone I know. His 8 year old daughter told her teacher that Dad smoked pot and she wanted him to stop. The police were called and Dad was picked up at work and brought home to be there when the search warrant was delivered. It cost him a couple thousand in attorney fees but he didn't go to jail. Unfortunately, he didn't learn his lesson and was busted a few years later.

**A: yes, the child has the right to ask for council, school council.
Now if you are asking about legal counsel, I agree with the previous posters.
